These Terms of Service ("Terms") govern your access to and use of the website operated by Broken Rosary LLC ("we," "us," or "our") and any purchases made through our online store.
By using our Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
PLEASE READ SECTION 9 CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION, WAIVES YOUR RIGHT TO A JURY TRIAL, AND WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT WITHIN 30 DAYS.
1. Use of the site
You may use this Site for personal, non-commercial purposes only. You agree not to:
- Use the Site for any unlawful or unauthorized purpose
- Interfere with or disrupt the Site or its security
- Attempt to gain unauthorized access to systems or data
We reserve the right to restrict or terminate access to the Site at our discretion.
2. Products and orders

Product availability is not guaranteed. Orders are only confirmed once you receive a shipping confirmation email.

6. Limitation of liability
To the fullest extent permitted by law, Broken Rosary LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or purchase of products.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
7. Indemnification
You agree to indemnify and hold harmless Broken Rosary LLC and its affiliates, officers, employees, and partners from any claims, damages, or expenses arising out of your violation of these Terms or misuse of the Site.
8. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Nothing in these Terms limits any rights you may have under the consumer protection laws of your state or country of residence.
9. Dispute resolution, arbitration, and class action waiver
9.1 Informal resolution first. Before starting an arbitration, you agree to first contact us at support@brokenrosary.com with a written description of the dispute and the relief you are seeking, and to give us 60 days to resolve it informally. Most issues are resolved at this stage. This step is a condition of starting an arbitration, and the time limit for bringing a claim is paused while it runs.
9.2 Agreement to arbitrate. If we cannot resolve the dispute informally, you and Broken Rosary LLC agree that any dispute arising out of or relating to these Terms, the Site, or any product purchased from us will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
9.3 Small claims exception. Either party may instead bring an individual claim in small claims court, if the claim qualifies and stays in that court.
9.4 Class action waiver. You and Broken Rosary LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
9.5 Coordinated claims. If 25 or more similar arbitration demands are filed against us by or with the assistance of the same law firm or coordinated group, the demands will be processed in batches of no more than 50 at a time. Each batch will be treated as a single consolidated arbitration with one arbitrator, one set of filing fees, and one hearing. The parties will cooperate with the administrator to implement this batching, and the time limit for bringing a claim is paused for all demands in the queue while batches proceed.
9.6 Your right to opt out. You may opt out of this Section 9 by emailing support@brokenrosary.com within 30 days of your first purchase or first use of the Site, whichever comes first, with your name, the email address on your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms, and it will not affect your account or your orders in any way.
9.7 Jury trial waiver. Except as provided above, you and Broken Rosary LLC waive the right to a trial by jury.
9.8 Severability. If Section 9.4 is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in a court of competent jurisdiction in Delaware, and the remainder will proceed in arbitration. If any other part of Section 9 is found unenforceable, the rest of Section 9 remains in effect.
9.9 Venue for court proceedings. For any dispute not subject to arbitration, you and Broken Rosary LLC consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
10. Changes to these terms
We may update these Terms at any time. Changes will be effective upon posting on this page.
